MADISONVILLE, KY - A jury returned a verdict for $42,750,000 for wrongful death and negligence against Harborside Healthcare in Hopkins County Circuit Court.

Yesterday at 1:30 pm a jury declared for the plaintiff in a case regarding Mr. Joseph Clint Offutt, age 92. Mr. Offutt suffered from cancer and resided at Harborside Healthcare when he passed away for causes listed as dehydration.
 
The jury deliberated Friday afternoon and Tuesday then returned a verdict for the plaintiff in the amount of $42,750,000 total. One million awarded for Negligence Resulting in a Death. One million seven hundred fifty thousand dollars for Wrongful Loss of Consortium for wife Pearline. Forty Million for Punitive Damages.

iSurfNews spoke with Lisa Circeo of Wilkes & McHugh PA this afternoon in reference to the case. Mrs. Circeo stated “We felt warranted in the light of grievous nature of the case due to dehydration with a feeding tube present” “Mr. Offutt developed disfiguring and painful sores on his body during his short stay of 9 days at Harborside Nursing Home.”
 
The case was presented to them by Jerry Rhoads of Rhoads & Rhoads Attorneys in Madisonville as their firm specializes in this litigation and Wilkes & McHugh took the case based on the evidence in Mr. Offutt’s case and the state investigations in regards to allegations of not enough staff to meet the needs of residents according to Mrs. Circeo. She stated “The family and our firm hopes that this sends a message to corporations to not place profits over people and census over care.”
